Agreement to terms

These Terms of Service (“Terms”) govern your use of the website joehandlesit.com and the services provided by JoeHandlesIt LLC (“we,” “us,” or “our”). By using our website or services, you agree to these Terms.

Services

JoeHandlesIt LLC provides website design, hosting, maintenance, and management services for small business owners. Services are offered in three monthly tiers, with an optional Google Business Profile management add-on available on any tier. Features included on every tier:

• Custom website design and development (up to 15 sections or pages — articles and blog posts do not count toward this limit)
• Website hosting, security, and domain management
• Ongoing SEO and AEO optimization
• Access to a customer portal showing site performance statistics and SEO/AEO settings
• Professional email setup at your domain, including DNS authentication (SPF, DKIM, DMARC) and domain verification. If you do not already have business email, we will set you up on Google Workspace; the Google Workspace subscription is selected and paid for by you directly to Google (plans start at $8/month per email address), separate from our service fee. If you already use another email provider (Microsoft 365, Zoho, Fastmail, your existing host, etc.), we will configure your domain's DNS records to work with your existing email provider — no migration required
• Up to 3 straightforward content changes per month via email

Tier-specific features:

• Base + Content tier adds the Always-Fresh Content engine (a library of 12 articles custom-written for your business at launch, a new article each calendar quarter, with fresh content rotating onto your site approximately every two weeks) and site usage statistics in the customer portal.
• Base + Content + AI Lead Management tier adds a 24/7 AI website assistant with unlimited conversations that is engineered to qualify visitor inquiries (asking about needs, budget, intent, and timeline) and a lead-tracking section of the customer portal that stores qualified lead records with the associated conversation history.

Straightforward content changes include updates to text, images, business hours, contact information, and similar modifications to existing site content. Requests that require new page design, new site features, or significant development work are considered custom development and are scoped and quoted separately. Additional content changes beyond the 3 included per month can be requested and will be quoted on a per-change basis. Changes are processed during normal business hours and are typically completed within 2–3 business days.

Email setup help is limited to initial configuration. If you do not already have business email, this means creating the Google Workspace tenant on your domain, configuring DNS authentication records, and provisioning initial user accounts; you select and pay for the Google Workspace plan that fits your business (plans start at $8/month per email address), billed by Google directly and separate from our service fee. If you already use another email provider, this means configuring your domain's DNS records (MX, SPF, DKIM, DMARC, and any provider-specific records) to route mail through that provider; the provider relationship and its billing remain entirely yours. Ongoing email support (troubleshooting mail clients, resetting passwords, syncing devices, etc.) is handled by your email provider or by you as the account owner — it is not included in our service.

Pricing and payment

• Service is offered in three monthly tiers, billed monthly with no setup fees, design fees, or consultation fees: Base — $59/month, Base + Content — $79/month, and Base + Content + AI Lead Management — $99/month. An optional Google Business Profile management add-on is available for an additional $99/month on top of any tier. Tier and add-on changes may be requested at any time and take effect at the start of the next billing period. See the Pricing page for current features.
• Custom development features (booking systems, payment processing, integrations, etc.) are scoped and quoted individually, separate from the monthly service fee.
• Payment is billed monthly through Stripe, our third-party payment processor. We do not store your payment card details. You are responsible for keeping your payment method current through Stripe.
• If payment fails, we will attempt to notify you. Continued non-payment may result in service suspension.

Automatic renewal and cancellation

In accordance with the Illinois Automatic Contract Renewal Act (815 ILCS 601):

• Your subscription automatically renews each month at the rate of your selected tier ($59, $79, or $99/month), plus the Google Business Profile add-on if selected ($99/month), unless you cancel. You may switch tiers or add/remove the add-on at any time; changes take effect at the start of the next billing period.
• You may cancel at any time with no cancellation fee by contacting us through the contact form on our website or by emailing us. There is no long-term contract.
• Upon cancellation, your website will remain active through the end of your current billing period.
• After that period, your website will be taken offline.
• Your content (text, images, logos, and other materials you provided) is always yours. We will provide it upon request at any time, including upon cancellation.
• A full export of the website source code is available upon request after 6 months of continuous active service. Your site is built on open-source technology, so any qualified developer could continue maintaining it independently.

Your content

You retain ownership of all content you provide to us (text, images, logos, etc.). By providing content, you grant us a license to use it solely for the purpose of building and maintaining your website. We will not use your content for any other purpose without your permission.

AI assistant

The AI assistant is included only on the Base + Content + AI Lead Management tier and is designed to answer visitor questions about your business and qualify leads. While we make every effort to ensure accuracy, the AI assistant may occasionally provide imperfect responses. We are not liable for actions taken by visitors based on information provided by the AI assistant. You are responsible for reviewing and keeping your business information up to date so the assistant has accurate context.

Intellectual property

The website design, code, and infrastructure we create remain the property of JoeHandlesIt LLC. Your content remains yours. You may not resell, redistribute, or sublicense our website code or infrastructure.

Limitation of liability

To the fullest extent permitted by law, JoeHandlesIt LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. Our total liability for any claim arising from our services shall not exceed the amount you paid us in the three months preceding the claim.

Service availability

We strive for high uptime but do not guarantee uninterrupted service. We are not liable for downtime caused by factors outside our control, including third-party hosting providers, DNS issues, or force majeure events. We will make reasonable efforts to resolve any service disruptions promptly.

Acceptable use

You agree not to use our services for any unlawful purpose or to host content that is illegal, defamatory, or infringes on the rights of others. We reserve the right to refuse or terminate service for violations of this policy.

Changes to these terms

We may update these Terms from time to time. We will notify active clients of material changes. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.

Dispute resolution

If a dispute arises from these Terms or our services, we encourage you to contact us first so we can attempt to resolve it informally. If we cannot resolve the dispute informally, either party may pursue resolution through the courts as described below.

Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles. Any legal action or proceeding arising from these Terms shall be brought exclusively in the state or federal courts located in the State of Illinois, and you consent to the personal jurisdiction of such courts.
