Agreement to terms

These Terms of Service (“Terms”) govern your use of the website joehandlesit.com and the services provided by JoeHandlesIt LLC (“we,” “us,” or “our”). By using our website or services, you agree to these Terms.

Services

JoeHandlesIt LLC provides website design, hosting, maintenance, and management services for small business owners. Our standard service includes:

• Custom website design and development
• Website hosting, security, and domain management
• 24/7 AI website assistant (unlimited conversations)
• Automated blog content (2 articles per month)
• Ongoing SEO and AEO optimization
• Access to a customer portal with website analytics
• Unlimited content changes via email

Content changes include updates to text, images, business hours, contact information, and similar modifications to existing site content. Requests that require new page design, new site features, or significant development work are considered custom development and are scoped and quoted separately. Changes are processed during normal business hours and are typically completed within 2–3 business days.

Pricing and payment

• The service is $175 per month, everything included. There are no setup fees, design fees, or consultation fees.
• Custom development features (booking systems, payment processing, integrations, etc.) are scoped and quoted individually, separate from the monthly service fee.
• Payment is billed monthly through Stripe, our third-party payment processor. We do not store your payment card details. You are responsible for keeping your payment method current through Stripe.
• If payment fails, we will attempt to notify you. Continued non-payment may result in service suspension.

Automatic renewal and cancellation

In accordance with the Illinois Automatic Contract Renewal Act (815 ILCS 601):

• Your subscription automatically renews each month at $175 per month unless you cancel.
• You may cancel at any time with no cancellation fee by contacting us through the contact form on our website or by emailing us. There is no long-term contract.
• Upon cancellation, your website will remain active through the end of your current billing period.
• After that period, your website will be taken offline.
• Your content (text, images, logos, and other materials you provided) is always yours. We will provide it upon request at any time, including upon cancellation.
• A full export of the website source code is available upon request after 6 months of continuous active service. Your site is built on open-source technology, so any qualified developer could continue maintaining it independently.

Referral program

• You earn $25 per month for each customer you refer who becomes an active subscriber.
• You earn $10 per month for each second-level referral (someone referred by someone you referred).
• Referral credits are applied to your monthly bill. If your credits exceed your monthly service cost, the difference is paid out to you.
• Referral credits are active only while the referred customer remains an active subscriber.
• We reserve the right to modify or discontinue the referral program at any time with 30 days notice.

Your content

You retain ownership of all content you provide to us (text, images, logos, etc.). By providing content, you grant us a license to use it solely for the purpose of building and maintaining your website. We will not use your content for any other purpose without your permission.

AI assistant

The AI assistant on your website is designed to answer visitor questions about your business. While we make every effort to ensure accuracy, the AI assistant may occasionally provide imperfect responses. We are not liable for actions taken by visitors based on information provided by the AI assistant. You are responsible for reviewing and keeping your business information up to date so the assistant has accurate context.

Intellectual property

The website design, code, and infrastructure we create remain the property of JoeHandlesIt LLC. Your content remains yours. You may not resell, redistribute, or sublicense our website code or infrastructure.

Limitation of liability

To the fullest extent permitted by law, JoeHandlesIt LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. Our total liability for any claim arising from our services shall not exceed the amount you paid us in the three months preceding the claim.

Service availability

We strive for high uptime but do not guarantee uninterrupted service. We are not liable for downtime caused by factors outside our control, including third-party hosting providers, DNS issues, or force majeure events. We will make reasonable efforts to resolve any service disruptions promptly.

Acceptable use

You agree not to use our services for any unlawful purpose or to host content that is illegal, defamatory, or infringes on the rights of others. We reserve the right to refuse or terminate service for violations of this policy.

Changes to these terms

We may update these Terms from time to time. We will notify active clients of material changes. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.

Dispute resolution

If a dispute arises from these Terms or our services, we encourage you to contact us first so we can attempt to resolve it informally. If we cannot resolve the dispute informally, either party may pursue resolution through the courts as described below.

Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles. Any legal action or proceeding arising from these Terms shall be brought exclusively in the state or federal courts located in the State of Illinois, and you consent to the personal jurisdiction of such courts.
